Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and aiphotodetect.com / Internet Mate Ltd, a company registered in England and Wales ("Company", "we", "us", or "our"), governing your access to and use of the AI Photo Detect website, web application, and API services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Acceptable Use Policy, which are incorporated herein by reference.

If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and "you" and "your" will refer to that organisation.

Description of Service

AI Photo Detect provides AI-powered image analysis services to detect whether photographs and images have been generated or manipulated by artificial intelligence systems. The Service includes:

• Web Application: A browser-based interface for uploading and analysing images
• REST API: Programmatic access for integrating AI detection into your applications
• Dashboard: Account management, usage analytics, and API key management
• Detection Reports: Analysis results indicating the likelihood that an image is AI-generated

The Service utilises third-party AI detection technology to perform image analysis. Detection results are provided on an advisory basis and should not be considered definitive determinations.

Accounts & Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised use of your account

3.2 Account Eligibility

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3.3 Account Security

You are solely responsible for safeguarding your account credentials, including any API keys issued to you. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

Subscriptions & Payment

4.1 Subscription Plans

The Service is offered through various subscription plans, each with different features, usage limits, and pricing. Current plans and pricing are available on our website. We reserve the right to modify plans and pricing at any time with 30 days' notice.

4.2 Free Trial & Free Tier

New users may receive a limited number of free AI detection requests. Free tier allowances are subject to change and may be modified or discontinued at our discretion.

4.3 Billing & Payment

Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed through our third-party payment processor (Stripe). By subscribing to a paid plan, you authorise us to charge your payment method for all fees associated with your subscription.

• All fees are quoted and payable in British Pounds (GBP) or US Dollars (USD) as indicated
• Fees are exclusive of applicable taxes, which will be added where required
• You are responsible for providing accurate billing information

4.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account dashboard.

4.5 Refunds

Subscription fees are non-refundable except where required by applicable law. If you cancel your subscription, you will retain access to paid features until the end of your current billing period.

4.6 Overages

If you exceed your plan's usage limits, additional charges may apply as specified in your plan details. We will notify you when you approach your usage limits.

API Usage

5.1 API Keys

Access to the API requires valid API keys, which are issued through your account dashboard. You agree to:

• Keep your API keys confidential and secure
• Not share API keys with unauthorised third parties
• Immediately revoke and regenerate any compromised API keys
• Accept responsibility for all API usage under your keys

5.2 Rate Limits

API requests are subject to rate limits based on your subscription plan. Exceeding rate limits may result in temporary throttling or blocking of requests. We reserve the right to impose additional rate limits to maintain service stability.

5.3 API Availability

While we strive to maintain high availability, the API is provided "as is" and we do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability.

5.4 API Changes

We may modify, update, or deprecate API endpoints with reasonable notice. We will endeavour to maintain backward compatibility where possible and provide migration guidance for breaking changes.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service complies with all applicable laws, regulations, and third-party rights.

Acceptable uses of the Service include, but are not limited to:

• Verifying the authenticity of images for journalistic or editorial purposes
• Content moderation for platforms and communities
• Academic research on AI-generated imagery
• Personal verification of images received online
• Business due diligence and fraud prevention

Prohibited Activities

You agree NOT to use the Service to:

7.1 Illegal Content

• Child Sexual Abuse Material (CSAM): Upload, transmit, or analyse any images depicting child sexual exploitation or abuse. This is strictly prohibited and will be reported to law enforcement authorities including the National Crime Agency (UK) and NCMEC (US).
• Non-consensual intimate imagery: Images depicting individuals in intimate situations without their consent
• Content depicting illegal acts: Images of violence, terrorism, or other criminal activity

7.2 Harmful Activities

• Attempting to circumvent usage limits or rate limiting
• Reverse engineering, decompiling, or attempting to extract source code
• Interfering with or disrupting the Service or its infrastructure
• Accessing accounts or data belonging to other users
• Using the Service to develop a competing product or service
• Using the Service to train machine learning or AI models
• Reselling, sublicensing, or redistributing the Service without authorisation

7.3 Fraudulent Use

• Using the Service to facilitate fraud, phishing, or scams
• Creating false or misleading reports about image authenticity
• Misrepresenting the source or nature of detection results
• Using the Service in any manner that violates applicable laws

7.4 Abuse of Service

• Automated scraping or bulk collection of detection results
• Sharing API keys or account access with unauthorised parties
• Circumventing technical measures designed to enforce these Terms
• Any activity that places excessive load on our infrastructure

User Content & Data

8.1 Your Content

You retain all ownership rights to images and content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, worldwide licence to process, analyse, and store such content solely for the purpose of providing the Service.

8.2 Content Warranties

You represent and warrant that:

• You own or have the necessary rights to upload and analyse the User Content
• Your use of the Service does not violate any third-party rights
• The User Content does not contain illegal material
• You have obtained all necessary consents for any personal data contained in User Content

8.3 Data Retention

Uploaded images are processed for analysis and may be temporarily stored in accordance with our Privacy Policy. We do not retain uploaded images longer than necessary to provide the Service unless required by law.

8.4 Data Protection

We process personal data in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Please refer to our Privacy Policy for details on how we collect, use, and protect your data.

Third-Party Services

9.1 AI Detection Technology

The Service utilises third-party AI detection technology to analyse images. While we carefully select and monitor our technology partners, we do not control and are not responsible for the underlying detection algorithms or their accuracy.

9.2 Payment Processing

Payment processing is provided by Stripe, Inc. Your use of payment services is subject to Stripe's terms of service and privacy policy.

9.3 Authentication Services

User authentication may be provided by third-party identity services. Your use of such services is subject to their respective terms and privacy policies.

9.4 Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites.

Accuracy & Disclaimers

10.1 Advisory Nature of Results

AI PHOTO DETECT DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DETECTION RESULTS. Detection results represent probabilistic assessments and should be considered advisory only. The Service:

• May produce false positives (incorrectly identifying authentic images as AI-generated)
• May produce false negatives (failing to detect AI-generated images)
• Cannot guarantee detection of all AI generation techniques
• May have varying accuracy across different image types, qualities, and AI models

10.2 No Professional Advice

Detection results do not constitute legal, professional, or expert advice. You should not rely solely on detection results for decisions with legal, financial, or significant consequences. We recommend seeking appropriate professional advice where necessary.

10.3 Evolving Technology

AI image generation technology is rapidly evolving. Detection accuracy may vary as new AI generation techniques emerge. We make no guarantee that the Service will detect images created by future AI models or techniques.

10.4 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

11.1 Exclusion of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIPHOTODETECT.COM / INTERNET MATE LTD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, revenue, or business opportunities
• Loss of data or goodwill
• Service interruption or computer damage
• Cost of substitute services
• Any damages arising from detection inaccuracies
• Any damages arising from unauthorised access to your account

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

11.2 Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).

11.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11.4 Essential Purpose

The limitations in this section shall apply even if any limited remedy fails of its essential purpose.

Indemnification

You agree to defend, indemnify, and hold harmless aiphotodetect.com / Internet Mate Ltd and its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your User Content
• Any claim that your User Content caused damage to a third party
• Your violation of any applicable law or regulation

We reserve the right to assume exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence of such claims.

Termination

13.1 Termination by You

You may terminate your account at any time by cancelling your subscription through your account dashboard or by contacting us. Upon termination, your right to use the Service will immediately cease.

13.2 Termination by Us

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation:

• Breach of these Terms
• Violation of the Acceptable Use Policy or Prohibited Activities
• Non-payment of fees
• Fraudulent or illegal activity
• Upon request by law enforcement or government agencies

13.3 Effect of Termination

Upon termination:

• All licences granted to you will immediately terminate
• You must cease all use of the Service
• We may delete your account data in accordance with our data retention policies
• Any fees owed will become immediately due and payable
• Provisions that by their nature should survive termination shall survive

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on our website with a new "Last Updated" date
• Sending an email notification to the address associated with your account
• Displaying a notice within the Service

Material changes will become effective thirty (30) days after posting, unless otherwise specified. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must discontinue use of the Service before the effective date. You may terminate your account without penalty within ten (10) days of the effective date if you object to material changes.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

15.2 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of England and Wales, and you consent to the personal jurisdiction of such courts.

15.3 Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.4 Entire Agreement

These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
